Court Of Appeal Quashes DPP’s Charges Against Muslim Clerics

Court of Appeal judges led by the Deputy Chief Justice Aliphonse Owiny Dollo has dismissed the appeal filed by the Director of Public Prosecution (DPP) challenging the acquittal of Sheikh Yunus Kamoga on charges of murdering fellow Muslim clerics.

In August 2017, three justices of the International Crimes Division of High Court in Kampala delivered a unanimous judgement acquitting Kamoga of murdering Sheikh Mustapha Bahiga and attempted murder of Sheikh Haruna Jemba.

The court, however, found him guilty of terrorism charges alongside four others.

A few days ago, the State filed an appeal challenging this acquittal.

The DPP in the appeal accused the lower court of failure to properly evaluate the evidence that was presented to them.

The appellant court judges, however, ruled yesterday that this appeal was filed out of time, as the rules of procedure require one to file an appeal within 14 days after the judgement.

This appeal was filed mid this month, a year after they had received the High court judgement.

In his appeal the DPP wanted Amir Kinene, Sheikh Yunusu Kamoga , Muluta Mudde Bukenya Bukenya, Sirajje Kawooya , Fahad Kalungi , Yusuf Kakande and Abdul Salaam Ssekayanja to be convicted of murdering Muslim clerics.DM and Agencies
