Drama In Court As Besigye Trial Stalls Over Licensing Battle For Defense Lawyers

The trial of opposition figure Dr. Kizza Besigye and his co-accused, Hajj Obeid Lutale Kamulegeya, has been postponed to December 10, 2024, by the Makindye General Court Martial after a heated debate over defense counsel preparations and licensing.

The adjournment follows a request by lead defense lawyer Erias Lukwago, who sought time to finalize the clearance of renowned Kenyan lawyer Martha Karua to practice in Uganda. Karua, a prominent figure in Kenyan politics, is poised to lead the defense team but faces delays due to pending approval from the Uganda Law Council.

Brigadier General Freeman Robert Mugabe, chairing the court, declined Lukwago’s request for an earlier hearing, citing the court’s congested calendar. “We have a full schedule this week, so we will resume on December 10 to ensure proper handling of the case,” he stated.

Karua expressed frustration over the hold-up. “The delay in granting my practice license is disappointing. We submitted our application in good time, and I hope for swift action to avoid further disruption,” she said.

The defense team faced additional hurdles as a group of over 20 lawyers, including Karua, were initially denied access to the courtroom due to security protocols. The standoff caused a 20-minute delay before they were allowed entry.

Once inside, Lukwago requested and secured a private 30-minute meeting with Besigye and Kamulegeya to strategize on critical legal issues, including jurisdictional challenges against the court.
