Sickly Dr. Besigye, Lutale Formally Apply For Bail In Treason Case

Former presidential candidate Dr. Kizza Besigye and his co-accused, Haji Obeid Kamulegeya Lutale, have formally applied for bail as they remain in remand on treason-related charges. The two, alongside UPDF officer Capt. Denis Oola, were charged before the Nakawa Chief Magistrates Court on February 21, 2025.

However, since treason is a capital offense, the magistrate’s court lacks jurisdiction to hear their bail request, leading them to seek relief from the High Court in Kampala.

On February 27, Dr. Besigye, through his legal team led by Lukwago & Co. Advocates, filed his bail application, citing several reasons for his release. He argues that his continued detention is politically motivated, claiming he is being persecuted for defending constitutional rights and advocating for citizens’ freedoms.

Among his reasons, Besigye highlights his advanced age, stating that at 68 years old, he struggles to cope with the difficult conditions in Luzira Prison. He also notes that despite being in detention for over 100 days, investigations into his case have not progressed to the High Court, further prolonging his uncertainty. Additionally, he emphasizes his past compliance with bail conditions in previous cases, including prior treason and rape charges, where he consistently attended court hearings.

Haji Lutale, aged 65, has also filed a separate bail application, raising similar arguments. He contends that he has no pending cases, poses no threat to the investigation process, and has a history of abiding by legal conditions. Furthermore, he asserts his constitutional right to bail, emphasizing the principle of innocence until proven guilty.

The court is expected to determine whether the two opposition figures will be temporarily released as they await further legal proceedings.
