ULS Rebukes Museveni’s Remarks On Dr Besigye Treason Case

The Uganda Law Society (ULS) has expressed concern over recent remarks made by President Yoweri Museveni regarding the treason case involving opposition figure Dr. Kizza Besigye, arguing that such comments could undermine the independence of the Judiciary.

During a televised address on Saturday, President Museveni questioned the prolonged nature of Besigye’s trial, suggesting that the accused should focus on defending himself in court instead of repeatedly raising legal objections. He also criticized the practice of granting bail in serious criminal cases, claiming that suspects who may interfere with witnesses should not easily secure release before trial.

In response, the Uganda Law Society issued a statement asserting that public comments by the Head of State on an active court case risk influencing judicial proceedings and may affect public confidence in the fairness of the legal process.

The society argued that courts must be allowed to determine cases independently, without pressure or commentary from any arm of government.

ULS President Isaac K. Ssemakadde called on the Judiciary’s leadership to reaffirm its independence and safeguard the constitutional principle of separation of powers.

He maintained that decisions concerning bail are solely the responsibility of the courts, guided by the Constitution and the facts presented in each case.

The legal body further argued that limiting or abolishing bail would conflict with constitutional protections such as the presumption of innocence and the right to personal liberty. It also noted that Uganda’s legal framework is aligned with international standards that recognize bail as an important safeguard within the criminal justice system.

Beyond the debate over bail, the ULS urged the government to prioritize reforms aimed at improving the justice sector.

These include addressing case backlogs, strengthening witness protection mechanisms, tackling corruption, and ensuring that judicial officers can perform their duties without political or external influence.

The statement comes as Dr. Besigye continues to face treason charges before the civilian courts following the transfer of his case from the military justice system after the Supreme Court ruled that civilians should not be tried by military courts.

Since then, the proceedings have involved several legal challenges relating to the conduct of the prosecution and procedural matters.

The Uganda Law Society reaffirmed its commitment to promoting constitutionalism, protecting the rule of law, and defending the independence of Uganda’s Judiciary.
