Too Old: EC Ejects Blaise Kamugisha From National Youth Elections

The independent Electoral Commission of Uganda had ejected the National Crime Preventers chief coordinator Blaise Kamugisha from taking over the National Youth Council Chairmanship.
In a letter addressed to Moses Chris Mufakinanye, who lodged a complaint challenging  Blaise to contest in the same post due to age.

EC has responded in his favour by saying that Mr Kamugisha is overage hence illegible to run for the NYC top Office.
Below is the Letter from EC

RE: ELECTORAL COMMISSION DECISION ON THE COMPLAINT LODGED UNDER SECTION 011 15 THE ELECTORAL COMMISSION ACT CA,10 IN RESPECT OF ALLEGED INELIGIBIUTY OF Mk BLASE KAMUGISHA FOR PURPOSES OF THE NATIONAL YOUTH COUNCIL AND COMMITTEE ELECTIONS

The above refers and we make reference to a meeting with the Commission conducted on 1st November, 2020 and 4th November,  in regard to the above captioned complaint lodged under Section 15 of the Electoral Commission Act Cap 140
This is to inform you that the Electoral Commission deliberated over the issues you raised in your complaint on inelegibility of Mr Blaise Kamugisha to participate in the above captioned election and also considered information obtained today, the 4″ of November 2020 from the telephone conversation with Mr. Blaise Kamugisha, and observed as hereunder.
Mr That Mr. Blaise Kamugisha was elected Chairperson of Rwencwera I Village and Kyera Parish Youth Council elections. respectively, under ID Number 63550217 with his date of birth indicated as 6th January, 1990.This information is corroborated with a copy of his Passport details tendered in as evidence during the hearing of your complaint.
The said passport No 91355366 was issued on 6th June 2016 and indicates that Mr Kamugisha Blaise was born on 6th January, 1990 in Kasana Uganda.

Other documents that accompanied the complaints show that Mr. Kamugisha Blaise participated In the National Resistance Movement primary Elections in Isingiro District on 2nd October 2020 for the Secretary of Finance elective office at District level and he did indicate his date of birth as 6th January, 1990:
That the said Kamigisha Blaise similarly was nominated by returning Officer, Isingiro electoral District for elective for the elective office of Secretary for Finance, NRM Isingiro District and declared accordingly at district level on 19 October 2020, a similar post he holds at the sub-county level having been accordingly declared on 16th September, 2020;

That Mr. Blaise Kamugisha changed his date of birth with National Identification and Registration Authority on 28th October,2020, This change was done after he had participated in all other levels of elections for this category.
(f) Where the outcome of an election has been declared, the Commission does not have the mandate to reverse or quash the same on account of any irregularity. That power lies with Courts of law; and  Under Section 1(9) of the National Youth Council Act, Cap 319.

A youth means a person between the age of eighteen and thirty years. Further. under Section 8 (9) of the said Act, any person holding an office in a youth council shall not vacate office on the sole reason that he or she has attained thirty years of age at any time during which his or her term of office. In view of the foregoing, the Commission, under MIN. COMP 24112020, found that Mr. Kamigisha Blaise is overage for purposes of the National Youth Committee election.
The said Mr. Kamigisha Blaise is therefore, not eligible to progressively be elected to the Youth Committee at National level.
